The contractual relationship of sale involves the delivery, in exchange for a price determined and publicly displayed through the website, of a specific product or service.

4. CONTRACTING PROCEDURE

In order to access the products offered by TRESLOCOS SL, the user must register through the website by creating a user account or make the purchase as a guest.

To make a purchase, the user must freely and voluntarily provide the personal data that will be required, which will be treated in accordance with the provisions of Regulation (EU) 2016/679 of April 27, 2016 (GDPR) and Organic Law 3/2018 of December 5 on the Protection of Personal Data and Guarantee of Digital Rights.

The user undertakes to make lawful and diligent use of the Access Keys, as well as not to make their Access Keys available to third parties.

The user undertakes to notify the staff of www.platadepalo.com as soon as possible of any loss or theft of the Access Codes, as well as any risk of access to them by a third party.

Access Keys may only be used by the users to whom they have been assigned. www.platadepalo.com is exonerated from any type of liability that may arise for damages caused or suffered due to fraudulent use or lack of diligence in the safekeeping and custody of the Access Keys, loss or use in violation of the provisions of these General Conditions.

Once the user account has been created, please be advised that in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE), the contracting procedure will follow the following steps:

  5. Shipping costs. These are specified for each order.

  7. Order confirmation. Once the order has been confirmed, we will send you a confirmation email. The basket has no administrative link, it is only a section where you can simulate a budget without any commitment on either side.

5. ORDER DELIVERY

TRESLOCOS SL will not send any order until it has verified that payment has been made.

Delivery times are for products in immediate availability.
Prices include VAT, although you will see the amount broken down in the shopping cart.

Orders will be delivered to the delivery address freely designated by the user. Thus, TRESLOCOS assumes no responsibility when the delivery of the product or service does not take place as a result of the data provided by the user being false, inaccurate or incomplete or when delivery cannot be made for reasons beyond the control of the shipping company assigned for this purpose, such as the absence of the recipient.

Delivery dates or deadlines shall be deemed approximate, and delay shall not constitute a fundamental breach. Except in the event of unforeseen or extraordinary circumstances, the order, consisting of the product(s) listed in each Shipping Confirmation, shall be sent within the period indicated on the website when making the purchase, according to the shipping method selected and, in any case, within a maximum period of 30 days from the date of the Order Confirmation.

In the event that TRESLOCOS, SL has not delivered the merchandise after 30 days from the agreed delivery date, the client and/or User will be entitled to cancel the order and receive a refund of the total amount paid at no cost, and without any liability for damages attributable to the Provider, or will have the option of continuing with the purchase and establishing a new delivery date.

It is advisable, at the time of delivery, to check that everything is in accordance with your order and in perfect condition. If you are not satisfied with the items delivered or their condition, sign and indicate by hand on the carrier's delivery note the anomalies you found upon receipt.

Delivery will be deemed to have taken place when the order has been delivered to the person who purchased it or to another person indicated by the same. The order will be deemed to have been delivered when physical possession of the purchased items is acquired, which will be confirmed by the signature of the receipt of delivery of the order at the delivery address requested by the buyer.

It is the User's responsibility to verify the products upon receipt and to state any reservations and claims that may be justified in the delivery receipt document.

6. PRICE

The prices applicable to each product will be those published on the website and automatically applied by the contracting process in the last phase of the same. All prices published on the website, except for omissions or transcription or computer errors, are valid and include the corresponding VAT.

Prices on the website include VAT, but exclude shipping costs, which are added to the total amount due.

Before making a purchase, you can check all the details of your quote online: items, quantities, price, availability, shipping costs, fees, discounts, taxes and the total purchase price. Prices may change daily until the order is placed.

Once the order is placed, prices will remain the same whether the products are available or not.

7. SHIPPING COSTS

Shipping costs are included when saving the products in the shopping cart or basket, as they are calculated by the shipping method, weight of the products and the delivery address.

The products offered in this service are aimed at end consumers under the terms and conditions set forth in the Retail Trade Act. In this regard, any purchase request outside the parameters of an average consumer and/or mass requests for orders from the same buyer and/or recipient may not be attended to.

Prices do not include shipping costs or additional services, unless otherwise expressly agreed in writing.

Shipping costs will be free for purchases of at least 69.90 euros in Spain and the Balearic Islands.

In Europe they will be free from 119.90 euros, and in the USA and the rest of the world from 399.90 euros.

For orders destined for a country outside the European Union and/or the Canary Islands, the buyer will be responsible for any taxes and customs fees that may apply, in accordance with local legislation.

8. PAYMENT METHODS

Anyone who purchases products on the website is committed to payment at the time of confirming the purchase.

Payment for the purchased products and the respective shipping costs can be made through PAYPAL, with credit cards (VISA, VISA ELECTRON AND MASTERCARD) and, for national orders, through SEQURA (with which you can choose to finance your purchase in 4 installments), Bizum or bank transfer. TRESLOCOS, SL undertakes to use the most efficient and secure methods of current technology to transmit the data and payments for each transaction. These shipments will always be encrypted through a secure server (SSL).


In the event that the user makes payment by credit card, the bank details will be transmitted via a secure protocol to those responsible for providing the respective remote electronic payment services, without any third party being able to access them under any circumstances. Such data will never be used by TRESLOCOS, SL except to complete the procedures relating to the purchase, to issue the corresponding refunds in the event of any returns and to prevent and inform the police forces in the event of fraud being committed by the buyer.

The purchase price of the products and the shipping costs will be debited from the user's account at the time of order confirmation.

Within a maximum period of 48 hours from receipt of payment confirmation, TRESLOCOS, SL will send the user, by email, a confirmation of the purchase, including the order number. This confirmation is not valid as an invoice, only as proof of purchase.

The invoice corresponding to the purchase made will be sent to the customer in print by e-mail or together with the product or if the customer so requests. Credit card fraud is a crime and TRESLOCOS, SL will take legal action against anyone who makes a fraudulent transaction in our store.

9. VALUE ADDED TAX AND BILLING

In accordance with the tax regulations on Value Added Tax, the delivery of the articles will be deemed to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory, except for the Canary Islands, Ceuta and Melilla.

The applicable VAT rate will be the one legally in force for each product or service.

For orders to the Canary Islands, Ceuta and Melilla, deliveries will be exempt from VAT but subject to the taxes corresponding to these territories. You expressly authorize us to issue the invoice electronically, although you may indicate at any time your wish to receive an invoice in paper format, in which case, we will issue and send the invoice in this format.

10. RETURN POLICY. RIGHT OF WITHDRAWAL

The User has the same rights and deadlines to proceed with the return and/or claim any defects or flaws that the product may present, both online and offline.

10.1 RIGHT OF WITHDRAWAL

If the user is making the purchase as a final consumer and not as a merchant or entrepreneur, he or she has a period of fourteen calendar days, counting from the date of receipt of the product, to withdraw from the contract without the need for justification (article 71 of Law 3/2014 of March 27 on the protection of consumers and users).

The withdrawal period will expire 14 calendar days from the day on which you or a third party indicated by you, other than the carrier, acquired material possession of the goods, that is, from the date they were delivered to you.

To exercise the right of withdrawal, you must send us written communication through the contact addresses indicated above, collecting the information necessary for the correct identification of the order.

In the event of withdrawal from this contract, we will refund all payments received from you, including delivery charges (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us) without undue delay and in any event not later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will make such refund using the same means of payment used by you for the initial transaction. You will not incur any costs as a result of the refund. Notwithstanding the foregoing, we may withhold the refund until we have received the goods back or until you have supplied proof of having sent back the goods, whichever is the earliest.

There are exceptions to the right of withdrawal. The return will not apply to:

  • The supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery.
  • The supply of goods which, after delivery and taking into account their nature, have been inseparably mixed with other goods.
  • All items that include some degree of customization are not eligible for returns. Some degrees of customization are listed below:
    • The supply of goods made according to the consumer and user's specifications or clearly personalized
    • Earrings modified to screw nut.
    • Rings that are not standard sizes, that is, not sizes 12, 14, 16, 18 and 20.
    • Jewelry that includes engravings, letters or names.
    • Any other customization element that is not included in the standard website offering.

The right of withdrawal will not apply in the following cases:

  1. If the product is not in perfect condition or has suffered any damage, you must be careful with the product(s) while they are in your possession.
  2. If the product packaging is not the original packaging or is not in perfect condition. The original packaging must protect the product so that it is received in perfect condition. The use of seals and adhesive tapes applied directly to the product is prohibited. The item must be returned using or including all its original packaging, instructions and any other accompanying documents.
  3. When the product is opened, without being able to prove that it has not been used.
  4. When they are personalized products or those that, for reasons of hygiene or other legally provided exceptions, are not susceptible to this right.

10.2. SIZE CHANGE

In cases where you consider that the size of the purchased product does not fit your needs, and without prejudice to the right of withdrawal that you have legally and contractually, you may request a change of size within 14 days of delivery and select the size for which you wish to change the first product purchased, provided that it is the same product and there is stock to supply the request. Please note that this option will only be displayed when the above conditions are met.

Once you have requested a size change, we will be responsible for sending you the new product and making the change. You must, in any case, return the product without any undue delay and, in any case, within a maximum period of 14 calendar days from the Change Request.

10.3. PRODUCT RETURNS

In cases where you consider that at the time of delivery the product does not comply with the contract, you must contact us immediately through our contact channels, providing the product details, as well as the damage it has suffered, and we will tell you how to proceed. You must take the package to a GLS parcel shop, with the corresponding label that you can find through the link we provide on our website for returns.

We will carefully examine the returned product and will inform you by email within a reasonable period of time whether a refund or replacement is appropriate (if applicable). The refund or replacement of the item will be made as soon as possible and, in any case, within 14 days from the date on which we send you an email confirming that a refund or replacement of the non-compliant item is appropriate.

Amounts paid for products that are returned due to a defect or fault, when this actually exists, will be fully refunded, including the delivery costs incurred to deliver the item to you. The refund will be made using the same payment method used to pay for the purchase.

10.4. RETURN PROCEDURE

If the requirements of the previous points have been met, TRESLOCOS SL will send the user an email confirming acceptance of the return, and will proceed to refund the amount of the returned products. The shipping costs of the order will only be refunded in the case of defective or incorrect products.

If the order is returned to the origin because the logistics company could not deliver it to the recipient due to negligence, TRESLOCOS SL will be responsible for all the costs of the first reshipment. In the event that the logistics company has operated correctly, TRESLOCOS SL will not be responsible for the cost of reshipment. If in this situation the customer cancels the purchase, the amount of the item corresponding to the order will be refunded, but not the shipping and handling costs.

In the case of a return for personal reasons of the customer, the customer will be responsible for the return costs.

If the customer wishes to make an exchange, he/she must follow the return procedure and choose another product. The costs of the return will be borne by the customer and the costs of reshipping will follow the logistics cost policy applicable to a first shipment.

If the return or exchange is due to an error on the part of TRESLOCOS, SL with regard to shipping, TRESLOCOS, SL will be responsible for the costs of return and subsequent reshipment.

In any case, the customer must follow the detailed return procedure. TRESLOCOS, SL reserves the right to demand compensation to compensate for any damage suffered by the goods, as well as to recover the direct costs incurred by the return. Returns that do not follow the return procedure will not be accepted.

11. APPLICABLE WARRANTIES

The guarantee for products will be the one indicated in their description, when this product is eligible for it. In addition, all objects purchased by the User on this Website will have the legal guarantee of consumer goods, that is, their conformity with their description expressly indicated on the Portal and with these General Conditions.

TRESLOCOS SL ensures the quality of its jewellery and accessories through strict controls, also offering a 3-year guarantee against manufacturing defects.

This warranty does not cover damage resulting from misuse, neglect, accident, alteration, unauthorized repair, or normal wear and tear from everyday use. The warranty will be voided if the jewelry is found to have been mishandled or misused, including, but not limited to, breakage, scratches, exposure to harsh chemicals, or any other type of abuse that affects the integrity of the jewelry. It also does not cover wear and tear on gold-plated pieces or soiling of the same.

12. RESPONSIBILITY AND DISCLAIMER OF LIABILITY

The liability of TRESLOCOS, SL in relation to any product purchased on this website will be strictly limited to the purchase price of said product.

All product descriptions, information and materials appearing on this website are provided "as is" and without express or implied warranties about them except those established by law. In this sense, if you contract as a consumer/user, TRESLOCOS, SL is obliged to deliver items that are in accordance with the contract, responding to you for any lack of conformity that exists at the time of delivery of the product. It is understood that the products are in accordance with the contract provided that

(i) conform to the description made by us and possess the qualities that we have presented on this website,

(ii) are suitable for the uses for which products of the same type are ordinarily intended and

(iii) present the quality and performance normally expected from a product of the same type.

TRESLOCOS, SL shall be liable to the User for any lack of conformity that exists at the time of delivery of the product. TRESLOCOS, SL grants the User the right to repair the product, to replace it, to reduce the price and to terminate the contract.

If the product does not comply with the agreed conditions, the User may choose between demanding its repair or replacement, unless one of these options is impossible or disproportionate, based on the provisions of Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.

13. INDUSTRIAL AND INTELLECTUAL PROPERTY

The trademarks and logos appearing on our website are registered and may not be used without written agreement with the person responsible for the website. TRESLOCOS, SL is the owner and holds a license for their use.

14. COMMUNICATIONS BETWEEN TRESLOCOS, SL AND THE USERS

15. FORCE MAJEURE

TRESLOCOS, SL shall not be liable for any delays or failures that may occur in the access, operation and functionality of the Website, its Contents and/or Services, nor for any interruptions, suspensions or malfunctions thereof, when they are caused by breakdowns caused by natural disasters such as earthquakes, floods, lightning or fires, situations of force majeure, situations of extreme urgency such as wars, military operations, civil unrest, strikes, lockouts or any other situation of force majeure or fortuitous cause.

16. PROTECTION OF PERSONAL DATA

TRESLOCOS, SL is deeply committed to compliance with European and Spanish regulations on the protection of personal data, and guarantees full compliance with the obligations set forth in both Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights, and in EU Regulation 679/2016
